Patna High Court Cr.Misc. No.35329 of 2014 (5) dt.06-08-2015 2/3 CORAM: HONOURABLE MR. JUSTICE DINESH KUMAR SINGH ORAL ORDER 06-08-2015 Heard learned counsels for the petitioners and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 419, 420 and 414 of the Indian Penal Code.
It is alleged that on the basis of information that coaccused Madhusudan Yadav used to cheat public by giving fake advertisement in the news paper as well as by mobile phone, raid was being laid when said Madhusudan Yadav was apprehended while talking on phone who admitted the act of cheating and from whom, mobile numbers of several persons were recovered. The names of the petitioners sprang up on the confession of co-accused Madhusudan Yadav.
It is submitted by learned counsel for the petitioners that except confession, nothing transpired against any of the petitioners during investigation and this fact has not been controverted by learned counsel for the State. Moreover, other similarly situated accused persons have been granted anticipatory bail vide Cr. Misc. Nos. 40217 of 2013 and 7839 of 2014. A statement has been made in para 3 of the petition that the petitioners have no criminal antecedent.
Considering the aforesaid facts, let the above named
Patna High Court Cr.Misc. No.35329 of 2014 (5) dt.06-08-2015 3/3 petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned C.J.M., Nawada in connection with Kashichak (Shahpur O.P.)
