JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 23-11-2021 Heard learned counsel for the petitioner and the State. Petitioner seeks regular bail in a case registered for the offence punishable under Section 354 of the Indian Penal Code, u/s 8/10 of POCSO Act and u/s 34, 37(C ) and 37(D) of Bihar Prohibition & Excise Act.

As per the prosecution case, the daughter of informant went for tuition but when she did not return till 7 PM, the informant tried to search her daughter and found her in unconscious position in the house of Arvind Prasad and Pravin Kumar. In the house, the petitioner and other accused persons were in drunken condition and it is alleged that they made her daughter drink wine as a result of which she became unconscious.

Learned counsel appearing for the petitioner submits

Patna High Court CR. MISC. No.48565 of 2021(2) dt.23-11-2021 2/2 that petitioner is innocent and has falsely been implicated in the case and there is no allegation of sexual harassment or assault against this petitioner nor the victim has alleged any molestation or sexual harassment against this petitioner. Petitioner claims clean antecedent and is in custody since 15.02.2021 and investigation in this case is complete.

Learned counsel appearing for the State opposes the prayer for bail.

Considering the facts of the case and the period of custody of the petitioner, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge-VI, Sheikhpura in connection with Korma PS case No.10/2021.
