JUSTICE PURNENDU SINGH ORAL JUDGMENT Date : 31-08-2023 Heard Mr. Ram Sevak Choudhary, learned counsel appearing on behalf of the petitioner and Mr. K. Singh, learned counsel appearing on behalf of the State.

2. Learned counsel appearing on behalf of the petitioner seeks to file detail representation before the District Programme Officer (Establishment), Munger for redressal of her grievance.

Patna High Court CWJC No.8984 of 2023 dt.31-08-2023 2/3 However, due to callous attitude of the District Programme Officer (Establishment), Munger and the Block Education Officer, the petitioner has been denied family pension.

3. Considering the aforesaid submission made on behalf of the parties as well as the relief as prayed for in the present writ petition, the District Programme Officer (Establishment), Munger is directed to call for the service records relating to the petitioner and issue sanction order to the Accountant General, Bihar for fixation of family pension of the petitioner in accordance with law.

4. The Treasury Officer, Munger, is directed to forthwith credit the family pension into the account of the petitioner once he receive authorization from the Accountant General Office.

5. In case, District Programme Officer (Establishment), Munger finds that certain formalities are requires to be done by filling up a form, he may depute a responsible Officer under his jurisdiction to get all those formalities personally filled up on behalf of the petitioner or he may provide the petitioner after visiting her house by assisting her so that further delay may not cause in making family pension of the petitioner.

6. The above exercise is directed to be concluded within a period of six weeks from the date of passing of the order.

7. Learned counsel appearing on behalf of the State must ensure to communicate this order even without uploading on Website today so that immediate steps be taken for giving all legal dues to the petitioner in accordance with law.

8. In case, any authorities do not cooperate with the District Education Officer, Munger, the petitioner is at liberty to take appropriate legal action against them.

9. With the above observation and direction the writ petition stands disposed of.
