Petitioner apprehends his arrest in connection with Narhat (Sitamarhi) P. S. case no. 85/2007 registered under section 307 and other allied sections of the IPC.

Although petitioner is named in the first information report but after due investigation, police submitted final form showing accusation against the petitioner untrue but the learned Chief Judicial Magistrate took cognizance against the petitioner also vide order dated 25.7.2008 which was challenged before the revisional court but his revision was dismissed on 24.6.2014 and after that petitioner has approached to learned Sessions Judge for grant of anticipatory bail which was rejected and then the petitioner has come before this court. Considering the aforesaid facts and circumstances as well as submissions of the parties, this anticipatory bail petition is allowed

Patna High Court Cr.Misc. No.4231 of 2015 (2) dt.02-02-2015 and it is ordered that in the event of arrest/ surrender within four weeks from the date of receipt of this order to the concerned court, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of Sri S.K. Mishra, Judicial Magistrate, Ist Class, Nawada/ concerned court in Narhat (Sitamarhi) P. S. case no. 85/2007 subject to condition as laid down under section 438(2) of the Cr.P.C. shahid (Hemant Kumar Srivastava,J) U T
