JUSTICE DINESH KUMAR SINGH ORAL ORDER 02-09-2015 The present application has been filed for modification of the order dated 02.09.2013 passed in Cr. Misc. No. 3708 of 2013 to the extent of slashing down the quantum of payment of undertaken amount of Rs. 18,00/- per month to Rs. 1,000/- per month.

It is submitted by learned counsel for the petitioner that petitioner is not only maintaining three children out of the wedlock but also the ailing mother. The order dated 02.09.2013 clearly stipulates that the present payment will be subject to any order being passed in matrimonial or maintenance proceeding. Moreover on the submission of counsel for the petitioner that petitioner is ready to make payment of Rs. 18,00/- per month to the informant, the order was passed.

Hence, in the circumstance, this Court is not inclined to interfere with the order dated 02.09.2013.

Let the trial be expedited.

Accordingly the modification application is disposed of in connection with Azam Nagar P.S. Case No. 150 of 2012, pending in the Court of learned Chief Judicial Magistrate, Katihar.
