JUSTICE DINESH KUMAR SINGH ORAL ORDER 24-05-2016 Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 188, 283, 291, 353 of the Indian Penal Code.
The prosecution case is that in an encroachment proceeding the petitioner failed to comply the undertaking of removing the encroachment and obstructed the officers in removing the encroachment.
It is submitted by learned counsel for the petitioner that there was dispute with regard to the claim of title of the land in question.
A statement has been made in para 3 of the petition that petitioner has no criminal antecedent. Considering the aforesaid facts, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of 12 weeks from today, be released on provisional anticipatory bail for six months on
Patna High Court Cr.Misc. No.23204 of 2016 (2) dt.24-05-2016 2/2 furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Birpur, Supaul in connection with Raghopur P.S. Case No. 59 of 2016, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. The provisional bail of the petitioner will be accepted by learned Court below if the petitioner will cooperate and appear in the encroachment proceeding without any default.
