JUSTICE VINOD KUMAR SINHA ORAL ORDER 08-08-2019 This is an application for grant of anticipatory bail in connection with Sasaram (M) P.S. Case No. 174 of 2018 disclosing offences under Sections 147, 341, 307, 323, 353 of the IPC and Sections 33, 41 and 42 of the Indian Forest Act. Prosecution story as per written report is that the informant-Forest Officer while on patrolling saw one truck loaded with stones, seeing him, the driver fled away and the truck was seized, which was brought to the forest office and it is alleged that in the meantime, 40-50 villagers including the petitioners, who are named in the F.I.R. came and started pelting the stones on the officials, causing injury to one Vishwa Nath Dubey.

Having heard both sides, considering the above submission, this application is allowed. Let the petitioners, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount to the satisfaction of learned Chief Judicial Magistrate, Rohtas at Sasaram, in connection with Sasaram (M) P.S. Case No. 174 of 2018, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure with condition that he has to cooperate the I.O. and appear before the I.O. as and when required, otherwise, his bail bonds shall be cancelled.
