JUSTICE DINESH KUMAR SINGH ORAL ORDER 26-05-2016 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 307,341,120B and 387/34 of the Indian Penal Code and section 27 of the Arms Act. The prosecution case is that six accused persons variously armed surrounded the informant when co accused Jitendra Sah fired as a result the informant fell down from his motorcycle, thereafter Sanjeev Kumar alias Pappu Sipahi fired causing injury on the left shoulder of the informant. It is alleged that the petitioner fired on the informant when pellet passed through the left jaw, thereafter co accused Amit Kumar alias Tuntun fired causing injury on the right shoulder of the informant.

Patna High Court Cr.Misc. No.23704 of 2016 (2) dt.26-05-2016 2/2 It is submitted by the learned counsel for the petitioner that for the occurrence of 1.2.2016 at 9.45 AM the FIR was registered on 3.2.2016 at 11.30 A.M. More over, due to political rivalry the accusation has been levelled.

Considering the nature of accusation, let the learned court below consider the prayer for regular bail of the petitioner in case the petitioner surrenders within six weeks from today in connection with Baniapur P.S. Case No. 33 of 2016 pending in the court of learned J.M. Ist Class, Saran at Chapra. This application is disposed of with the aforesaid observation/direction.
