2. Petitioner apprehends arrest in a case registered for the offence punishable under section 420 of the Indian Penal Code.

3. As per the prosecution case, money was transferred in petitioner's account for building a house under Pradhan Mantri Awas Yojana, but even after receipt of Rs. 45,000/- she did not complete the construction of the house.

4. It is submitted that petitioner is innocent and has falsely been implicated in this case. The petitioner has spent amount of Rs. 45000/- on bricks, sariya, sand and labour charge but due to non-disbursement of second installment she could not construct the house was not complete. She has not violated the

Patna High Court CR. MISC. No.44960 of 2023(2) dt.11-08-2023 2/2 norms of Pradhan Mantri Awas Yojana. Petitioner is poor lady. Petitioner claims clean antecedent.

5. Learned counsel for the State opposes the bail petition of the petitioner.

6. Considering the aforesaid facts and circumstances of the case, in the event of arrest or surrender within six weeks from today, let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate , Aurangabad in connection with Madanpur P.S. case no . 279 of 2022, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
