The petitioner seeks bail in Rampur P.S. case No. 306 of 2016 under Section 302 of the Indian Penal Code and under Section 27 of the Arms Act.

The informant lodged the case against unknown alleging that some unknown persons shot his brother, Ashif Moin Khan, dead.

The learned counsel for the petitioner submits that name of the petitioner figured in the case in the confessional statement of co-accused Rocky @ Md. Shamshad but Rocky @ Md. Shamshad has already been granted bail vide order passed in Cr. Misc. No. 11112 of 2017. Save and except suspicion, there is no tangible material against the petitioner.

Shamshad has already been enlarged on bail and the case of the petitioner stands on same footing, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Gaya in Rampur P.S.
