The petitioner seeks bail in a case instituted under Sections 420, 467, 468, 471, 379, 411 and 120B of the Indian Penal Code.
The allegation against the petitioner is that without valid challan and permit, he along with other co-accused transported the coal from Jharkhand to Bihar and the truck was intercepted.
It has been submitted on behalf of the petitioner that the petitioner is in custody since 23.01.2017. The charge sheet has been submitted in the present case. The petitioner has got no criminal antecedent. There is no allegation of tampering of
Patna High Court Cr.Misc. No.23431 of 2017 (2) dt.23-05-2017 2/2 witnesses alleged against the petitioner. The petitioner is said to be the driver of the truck, on which, the coal was being transported. The other co-accused have been granted anticipatory bail vide Cr. Misc. No. 16717 of 2017 by another co-ordinate Bench of this court.
On behalf of the state, it has been submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.D.J.-II, Aurangabad in connection with Barun P.S.
