JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 10-05-2017 Heard learned counsel for the petitioner and the State. The petitioner is in custody in a case registered under Sections 341, 323, 326, 307, 448, 427, 504, 385, 349 of the Indian Penal Code.

Accusation is that on 09.02.2017 in the evening Md. Shamshad (informant) was at his residence, this petitioner and one Jamshed came there and asked to open the door of his house. On refusal the both entered in the house after breaking the door and Jamshed stabbed in the belly of the informant. When the informant tried to save himself, this petitioner took knife in his hand and stabbed the informant and on raising alarm, the accused persons fled away from there.

Submission is that the petitioner is the wife of Tasvir

Patna High Court Cr.Misc. No.20044 of 2017 (2) dt.10-05-2017 2/2 Rahman and she has five children. Further submission is that, in fact, the informant was stabbed from knife by co-accused Jamshed but due to previous enmity, the petitioner has falsely been implicated in the present case. Only one stabbed would was found in the abdomen of the petitioner. The petitioner, who is a lady having no criminal antecedent is in custody since 11.02.2017. Having considered the facts and circumstances of the case, let, above named petitioner, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Araria in connection with Araria (R.S.) P.S.Case No. 74 of 2017.
