JUSTICE DINESH KUMAR SINGH ORAL ORDER 28-01-2015 Heard learned counsels for the petitioners and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 341, 323, 504, 506, 447, 379 and 307/34 of the Indian Penal Code, Section 3 (I) (X) of the SC/ST (Prevention of Atrocities) Act and Section 27 of the Arms Act.
It is alleged that all the accused persons entered into the house of the informant, abused him by calling caste name, assaulted the informant and his family members and snatched Rs. 5,000/-.
It is submitted by learned counsel for the petitioners that
Patna High Court Cr.Misc. No.3606 of 2015 (2) dt.28-01-2015 2/2 the accusation is omnibus and general. There is counter version of the occurrence also being Sare P.S. Case No. 71 of 2014 lodged by Deonath Chaudhary being the agnate of the informant against the informant and since the petitioner went to pacify the dispute, he has been named as accused. It has further been submitted that the admittedly the occurrence took place inside the house which cannot be treated to be a place of public view. A statement has been made in para 3 of the petition that the petitioners have no criminal antecedent.
Considering the aforesaid facts, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned C.J.M., Nalanda, Biharsharif in connection with SC/ST P.S. Case No. 50 of 2014, subject to the conditions as laid down under Section 438(2) Cr.P.C. (Dinesh Kumar Singh, J) Amrendra/- U T
