JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 11-05-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner seeks bail in connection with Asarganj P.S. Case No.82 of 2014, registered under Sections 147, 148, 448, 342, 324, 307, 379 and 302 of the Indian Penal Code.

The accusation is that on 18.08.2014 informant/deceased Sakuna Devi was at her house. At that time, Naresh Yadav, Mahesh Yadav and Sugiya Devi, wife of Naresh Yadav, Mithilesh Kumar and Munchun Yadav came near her and carried her at the Darwaja, where Mahesh Yadav, Munchun Yadav and Mithilesh Kumar (petitioner) caught hold her thereupon Sugiya Devi sprinkled kerosene oil on the person of informant and Naresh Yadav put her on fire and took Rs.2000/-

Patna High Court Cr.Misc. No.20084 of 2017 (2) dt.11-05-2017 2/2 from the box of the informant. Thereafter, she started to raise alarm then neighbours came then all the persons fled away. Learned counsel for the petitioner submits that similarly situated co-accused Mahesh Yadav, who is said to be also caught hold of the informant has already been granted privilege of bail by this Court vide order dated 26.07.2016 passed in Criminal Misc. No. 29586 of 2016. Further submission is that petitioner has no criminal antecedent is in custody since 05.12.2016.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Judicial Magistrate, 1st Class, Munger in connection with Asarganj P.S.
