JUSTICE VINOD KUMAR SINHA ORAL ORDER 27-11-2019 Petitioner seeks regular bail in connection with Samastipur Town P. S. Case No. 04 of 2018, registered for the offences punishable under Sections 392, 412 and 395 of IPC. As per F.I.R. there is loot of heavy amount of Rs. 48,94,325/- and a case has been lodged in this connection against unknown. It further appears that later on some articles were recovered, which has been identified by the bankers. There is CC TV footage also. However, the names of the robbers has not been mentioned. Even no TIP was held against the accused persons. Petitioner is in custody since 25.01.2018. Submission of the learned counsel for the petitioner is that in spite of there being a case since long no identification

Heard learned A.P.P. also, who has opposed the prayer for bail.

Having heard both sides, in view of the facts and circumstances, as stated above, let the petitioner above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of Additional Sessions Judge, 3rd, Samastipur, in connection with Samastipur Town P. S. Case No. 04 of 2018, subject to the condition that one of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the court concerned with condition that he has to co-operate in the trial and further condition that he has to appear before the local police station in the first week of each month for a period of 09 months.
