JUSTICE DINESH KUMAR SINGH ORAL ORDER 05-02-2015 Heard learned counsels for the petitioner and the State. The petitioner being the husband of the informant is apprehending arrest in a case registered for the offences punishable under Section 498A/34 of the Indian Penal Code and Section 3/4 of the Dowry Prohibition Act.
The accusation is of torture for non-fulfilment of the dowry demand.
It is submitted by learned counsel for the petitioner that when the informant eloped with someone, the petitioner's father lodged Jagdishpur P.S. Case No. 52 of 2014 making accusation under Sections 366A, 493 and 494 of the IPC on 06.06.2014 in which the grand-father and father of the informant were the witnesses, thereafter, the present case has been lodged as a retaliatory measure.

No.4954 of 2015 (2) dt.05-02-2015 2/2 Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Bhojpur at Arrah in connection with Aayar P.S. Case No. 107 of 2014, subject to the conditions as laid down under Section 438(2) Cr.P.C.
