JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 25-01-2021 Heard learned counsel for the petitioner and learned Additional Public Prosecutor appearing on behalf of the State. This application for grant of regular bail arises out of N.H. Bangra P.S. Case No. 108 of 2019 registered for the offence punishable under Sections 30 (a) and 41(i) of the Bihar Prohibition and Excise Act, 2016.

The petitioner had earlier approached this Court for grant of regular bail, which was rejected by an order dated 08.06.2020 passed in Cr. Misc. No. 19219 of 2020 considering the allegation that from the petitioner's house 128 liters of Indian made foreign liquor was recovered, his application was rejected.

Patna High Court CR. MISC. No.38206 of 2020(2) dt.25-01-2021 2/2 Learned counsel appearing on behalf of the petitioner has submitted that he is in custody since 18.02.2020 and he has no criminal antecedent.

Since the petitioner has remained in custody since 18.02.2020 and there is no likelihood of conclusion of trial in near future, this application is allowed.

Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-2nd-cum-Special Judge, Excise, Samastipur in N.H. Bangra P.S. Case No. 108 of 2019. It is subject to condition that if the petitioner is found indulging in such activities in future, the prosecution shall be at liberty to apply for cancellation of his bail granted by virtue of the present order.
