JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 13-01-2022 Heard learned counsel for the petitioner and learned A.P.P for the State through video conferencing. The petitioner seeks bail in Bettiah Town (Kalibagh OP) P.S. Case No. 121 of 2021, registered for the offence punishable under Sections 376D, 376B, 324, 307/34 of the Indian Penal Code and section 4, 6 and 17 of the POCSO Act. As per the prosecution case, this petitioner along with co-accused committed rape and brutally assaulted her. It is further alleged that both persons cut her neck by blade. It is submitted on behalf of the petitioner that petitioner has falsely been implicated in this case. It is further submitted that informant was medically examined, but no corroborative injury was found on the person of informant

Patna High Court CR. MISC. No.48558 of 2021(3) dt.13-01-2022 2/2 which itself falsify the allegation of rape. Petitioner is in custody since 22.02.2021 having no criminal antecedent. Counsel for informant however, vehemently opposed the prayer for bail.

Considering the facts aforesaid, nature and gravity of offence, I am not inclined to enlarge the petitioner above-named on bail. Accordingly, the same is rejected.
