The petitioner has prayed for bail in connection with Katihar Muffasil P.S. Case No. 15 of 2019 registered for the offence punishable under Section 392 of the Indian Penal Code. As per allegation in the FIR four accused persons, armed with pistol, forcibly took away the vehicle of the informant. The name of the petitioner transpired on the confession of the co-accused.

It is submitted by learned counsel for the petitioner that similarly situated co-accused persons have been enlarged on bail by different orders of this court. which have been brought on record as Annexure-2 series to this petition. He has further submitted that the name of the petitioner transpired on confession of the co-accused.

Patna High Court CR. MISC. No.35564 of 2019(3) dt.28-08-2019 2/2 He has not been put on Test Identification Parade. The investigation of the case has been concluded and he is in custody since 09.02.2019.

The application for bail is opposed by learned APP for the State.

Having heard learned counsel for the parties and considering the fact that petitioner has not been put on TIP, he has no criminal antecedent and is in custody since 09.02.2019, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Katihar in connection with Katihar (M) P.S. Case No. 15 of 2019.
