JUSTICE DINESH KUMAR SINGH ORAL ORDER 07-04-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under sections 302/201 of the Indian Penal Code.

It is alleged that the husband of the informant went in the company of Ranjan Kumar Jha, Sanjeev Kumar Jha and Bhola Jha. Subsequently, his dead body was recovered from an orchard leading to registration of FIR against six persons but the petitioner was not named. Subsequently, the name of the petitioner sprang up as the nephew of the informant suggested that the victim was seen in the company of several persons including the petitioner one day prior to the recovery of the dead body.

Patna High Court Cr.Misc. No.28006 of 2014 (4) dt.07-04-2015 Learned APP, after going through the case diary, submits that except the evidence of last seen, nothing has been collected against the petitioner.

The aforesaid facts constitute grounds for consideration of the prayer for regular bail of the petitioner by the learned court below in case the petitioners surrender within six weeks from today in connection with Samastipur (Mufassil) P.S. Case No. 48 of 2014 pending in the court of learned CJM, Samastipur. This application is disposed of with the aforesaid observation/direction.
