JUSTICE ANIL KUMAR SINHA ORAL ORDER 24-10-2019 The petitioner apprehends his arrest in connection with Pipra P. S. Case No. 02 of 2018 registered under Sections 323, 341, 342, 354, 365, 379, 384, 504 and 506/34of the Indian Penal Code.

Allegation against the petitioner is that informant who happened to be Branch Manager of Central Bank of India and while going to her Branch, she was intercepted by some persons sitting in a four-wheeler and the person sitting in car forcibly got her sit in car and they snatched her mobile phone and further demanded a sum of Rs. 10 lacs from her. It has further been alleged that upon raising alarm, accused persons thrown her on the road and fled away.

Learned counsel appearing on behalf of the petitioner

Patna High Court CR. MISC. No.37778 of 2019(4) dt.24-10-2019 2/3 submits that petitioner is not named in the FIR and he has no criminal antecedent. He further submits that no any incriminating material has been recovered from the possession of the petitioner. Learned counsel further submits that during the course of investigation one Nikesh Kumar was arrested from whose possession, the mobile phone of the informant was recovered and upon enquiry, arrested accused persons disclosed that the same has been purchased from the petitioner. Learned counsel appearing on behalf of the State, referring to para 29 of the case diary, submits that above mentioned mobile phone is mentioned in the case diary. He further submits that except this, no other material has come against the petitioner.

Having regard to the submissions made by the parties and taking into consideration the fact that petitioner has got no criminal antecedent and his name has been dragged on the basis of statement made by arrested co-accused person, as such I am inclined to grant anticipatory bail to the petitioner. Let the petitioner, above-named, in the event of arrest or surrender before the court below within a period of four weeks from the date of receipt of a copy of this order, be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties
