JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 09-02-2021 Heard learned counsel for the petitioner and State. The petitioner is in custody in connection with Koilwar P.S. Case No. 313 of 2020 for the offence under Sections 341, 323, 307, 498(A) of the Indian Penal Code. Learned counsel for the petitioner submits that the petitioner is working as technician in Jaipur and on his own earning a house was constructed at Patna and the opposite party no.2 is collecting rent from the said house for the last 15 years. He further submits that in order to oust the petitioner from the property, the present case has been lodged against the petitioner, who is the husband of opposite party no.2. The petitioner has got no criminal antecedent and he is in custody since

Considering the fact that the petitioner is the husband and he is in custody since 02.08.2020, the petitioner, named above, is directed to be released on bail on furnishing bail bonds of Rs.50,000/- (Rupees fifty thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Bhojpur at Ara in connection with Koilwar P.S. Case No. 313 of 2020.
