The petitioners being the brother and brother's wife of the husband of the victim are apprehending their arrest in a case registered for the offences punishable under Sections 304B/34 of the Indian Penal Code.
The prosecution case is of killing the daughter of the informant within one year of marriage by administering poison or putting her on fire.
It is submitted by learned counsel for the petitioners that on conclusion of the investigation the petitioners were not sent up for trial but differing with the final form
Patna High Court Cr.Misc. No.23490 of 2016 (2) dt.25-05-2016 2/2 cognizance has been taken by the learned Magistrate vide order dated 11.09.2015.
Considering the fact that the accusation has not been found true on conclusion of investigation against the petitioners, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Ist Class, Vaishali at Hajipur in connection with Desri P.S. Case No. 96 of 2013, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Dinesh Kumar Singh, J) DKS/- U T
