JUSTICE ASHUTOSH KUMAR ORAL ORDER 02-02-2021 Heard Mr. Vinod Kumar, learned counsel for the petitioner and the learned APP for the State. The petitioner seeks bail in connection with Excise Case No. 262 of 2020 instituted for the offence under Section 30(a) of Amended Bihar Prohibition of Wine & Excise Act, 2018.

It appears that 180 litres of liquor has been recovered from a vehicle of which the petitioner is said to be the driver.

Learned counsel for the petitioner has submitted that he has been falsely made accused in this case.

The petitioner is in custody since 29.06.2020 and does not have any criminal antecedent.

Apart from this, it has been submitted that he

Patna High Court CR. MISC. No.37031 of 2020(2) dt.02-02-2021 2/2 is not the owner of the vehicle and was asked to drive the vehicle without his information that the recovered liquor was kept in the boot of the vehicle.

Considering the aforestated facts and the period of custody of the petitioner, he is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge Excise, Gaya in connection with Excise Case No. 262 of 2020.
