JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 19-01-2017 Heard learned counsel for the petitioners and the learned A.P.P. for the State.
The petitioners are accused in connection with Taraiyan P.S. Case No. 274 of 2016 registered under Sections 341, 323, 325, 307, 379 and 504/34 of the Indian Penal Code. The accusation is that petitioners along with Ramdeo Rai armed with iron rod and lathi reached at the door of the informant and started to abuse. When the informant made protest then petitioner no. 1 caused injury at the head of informant whereas co-accused, Ram Deo Rai also caused fracture injury at the right hand of the informant through iron road. At that time, petitioner no. 2 took cash of Rs.30,000/- from the pocket of the informant. When the son of informant rushed to save him then petitioner no. 1 also caused injury through the butt of pistol at the
Patna High Court Cr.Misc. No.1768 of 2017 (2) dt.19-01-2017 forehead of son of the informant.
Learned counsel for the petitioners submits that petitioners and the informant are next door and they have falsely been implicated in this case due to ulterior motive. It is further submitted that petitioners have no criminal antecedent and are in custody since 07.12.2016.
Having regard to the facts and the circumstances of the case, the petitioners above named, are directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-IX, Saran, in connection with Taraiyan P.S. Case No. 274 of 2016. Out of two sureties, one surety must be the close relative of the petitioners.
