The petitioner seeks regular bail in connection with Mirganj P.S. Case No. 308 of 2015 registered for the offences punishable under Sections 414/34 of the Indian Penal Code. The S.H.O. of Mirganj, on information regarding assemblage of few miscreants near Hira Cinema, reached there and apprehended two persons out of three, who disclosed the name of this petitioner.

Learned counsel for the petitioner submits that the apprehended two accused namely, Ajay Kumar and Sanjay Kumar, who are named in the F.I.R., have been allowed bail vide order dated 22.01.2016 in Criminal Miscellaneous No.

Patna High Court Cr.Misc. No.5887 of 2017 (2) dt.15-02-2017 2/2 2078 of 2016 passed by another co-ordinate Bench of this Court. The petitioner is neither named in the F.I.R. nor he was arrested at the spot. The petitioner is in custody since 30.10.2016.

The learned APP for the State opposed the submission.

Considering the nature of allegation and the facts and circumstances stated above, the prayer of bail is allowed. The petitioner, named above, is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the each amount to the satisfaction of the learned Chief Judicial Magistrate, Gopalganj in connection with Mirganj P.S. Case No. 308 of 2015.
