JUSTICE DINESH KUMAR SINGH ORAL ORDER 05-02-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 272 and 273 of the Indian Penal Code and Section 47(a) of the Excise Act. 30 liters of Mahua liquor and equipment for manufacturing liquor were recovered from the land alleged to be of the petitioner.

It is submitted by learned counsel for the petitioner that there is nothing on record to suggest that the land, from where the recovery has been made, belongs to the petitioner and the detail of the seized equipment has not been mentioned in the seizure list. Moreover, the seizure was made on 14.03.2014 when the prosecution report was transmitted to learned In-charge CJM on 16.03.2014. A statement has been made in para 3 of the petition

Patna High Court Cr.Misc. No.4964 of 2015 (2) dt.05-02-2015 2/2 that the petitioner has no criminal antecedent. Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned J.M., 1st Class, Danapur, Patna in connection with Maner P.S. Case No. 83 of 2014, subject to the conditions as laid down under Section 438(2) Cr.P.C. (Dinesh Kumar Singh, J) Amrendra/- U T
