====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 13-02-2017 Heard learned counsel for the petitioners and the State. Petitioners seek bail in a case instituted for the offence under Section-307 of the Indian Penal Code and 27 of the Arms Act.

It has been alleged in the FIR that during removal of encroachment by JCB machine, some people tried to obstruct the same and thereafter, the petitioner No. 1 who is a retired Hawildar and his son made firing in air, on account of which, encroachment work was stopped. It has been submitted that the petitioners were assaulted by the people who had assembled there. From the written report itself, it appears that no injury was caused. It is merely alleged that the petitioners fired from his gun but admittedly, no injury has been caused to any person. Petitioners are languishing in jail custody since 15-11-2016.

No.4375 of 2017 (2) dt.13-02-2017 2/2 Considering the above-said facts and circumstances of the case, let the petitioners named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each in connection with Kotwali P.S. Case No. 543 of 2016 to the satisfaction of learned Chief Judicial Magistrate, Patna subject to condition that both the bailors will be close relatives of the petitioners.
