====================================================== CORAM: HONOURABLE MR. JUSTICE PARTHA SARTHY ORAL ORDER 04-09-2019 Heard learned counsel for the petitioner and learned APP for the State.

The petitioner who is in custody since 03.02.2019 has filed the instant application for grant of bail in connection with Nath Nagar P.S. Case as No. 66 of 2019 (G.R. No.408 of 2019) registered for the offence punishable under sections 457, 380, 411 and 413 of the Indian Penal Code.

As per F.I.R., while the informant was away from the house a burglary took place. On return, she found the locks of her house and rooms had been broken and various articles including ornaments had been stolen. An F.I.R. was registered against unknown persons.

It is submitted by learned counsel for the petitioner that the name of the petitioner transpired in course of

Patna High Court CR. MISC. No.38108 of 2019(3) dt.04-09-2019 2/2 investigation on confessional statement of co-accused Fulchand Sah before the police. The said Fulchand Sah has been enlarged on bail by order dated 11.7.2019 passed in Cr.Misc. No.41837 of 2019. No incriminating articles has been recovered from the possession of the petitioner. The petitioner is in custody since 31.01.2019 and has no criminal antecedent.

The application for bail was opposed by learned APP for the State.

Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case, the Court is inclined to enlarge the petitioner on bail. Let the petitioner, above named, be enlarged on bail on his furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-1, Bhagalpur in connection with Nath Nagar P.S. Case as No. 66 of 2019 (G.R. No.408 of 2019).
