JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 10-02-2022 Learned counsel for the petitioner is directed to remove all the defects pointed out by the Stamp Reporter within one month. Heard learned counsel for the petitioner as well as the learned APP for the State through video conferencing. The petitioner apprehends her arrest in connection with Birpur P.S. Case No. 101 of 2018, registered for the offences punishable under Sections 467, 468, 471, 420, 120 (B)/34 of Indian Penal Code.

As per allegation, the petitioner was employed as Panchayat Teacher on the basis of forged certificate. In inquiry, it was emerged that the roll number mentioned in the certificate of the petitioner was never issued by the Bihar School Examination Board. Learned counsel for the informant by drawing my attention towards Annexure-D of the counter affidavit has submitted that the Head Master of the school certified that the petitioner was

Learned counsel for the petitioner has submitted that on similar allegation some other accused persons have been granted anticipatory bail.

Considering the above-mentioned facts and circumstances the petitioner is also granted provisional anticipatory bail in the event of her arrest or surrender within four weeks before the learned court below on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, 1st Begusarai in connection with Birpur P.S. Case No. 101 of 2018, subject to the conditions as laid down under Section 438(2) Cr.P.C. with further condition that she will deposit 50% of the total amount which has been received by her as salary during her tenure as Panchayat Teacher in ten equal installments and the learned trial court shall itself confirm the bail bond on the deposit of the total installments of the stipulated amount and the petitioner shall also not claim her rights as Panchayat Teacher.

Office shall ensure that all defects are removed by the petitioner within the stipulated time provided in para-1 hereinabove, failing which the matter shall be brought to the notice of this Court. (Nawneet Kumar Pandey , J) SONALI/- U T
