1. Heard learned counsel for the petitioner and learned A.P.P. for the State.

2. The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 126(2), 115(2), 109(1), 352, 351(2) and 3(5) of the BNS, 2023.

Learned counsel for the petitioner submits that petitioner is a person with clean antecedent and the informant alleges that on 09.05.2025 at about 05:30 PM, he along with his friends were taking tea at Shivnagar Ghat crossing when four girls came on an auto after performing in an orchestra and the informant knew the name of one of the girls, i.e., Khushi, it is next alleges that in the same auto Mahadev (petitioner) was also sitting and he started abusing the friend of the informant,

No.42736 of 2026(3) dt.09-07-2026 2/3 namely, Ritesh on account of previous dispute, it is further alleged that Khushi came out of the auto and started abusing and assaulted the informant and his friends by knife causing injury to Shivam, Ritesh, Satyam and the informant and they were brought to Benipur Hospital from where they were referred to D.M.C.H.

Learned counsel appearing on behalf of the petitioner submits petitioner has been falsely implicated in the instant case by the informant, it is next submitted that from perusal of the allegation as alleged in the FIR, it would manifest that informant alleges that petitioner was also sitting in the auto and he abused Ritesh on account of previous dispute, but then as far as allegation of stabbing is alleged, the same is against Khushi, it is submitted that informant and his side were acting inappropriately with the girl who were sitting in the auto on account of which an altercation took place and Khushi was thrashed by the informant and his side as such in self-defence she assaulted them with knife, it is also submitted that even Kushi was admitted at D.M.C.H. Darbhanga and her fardbayan was recorded based on which Biraul P. S. Case No. 151 of 2025 came to be instituted against the informant and his side. It is reiterated and submitted that petitioner is not alleged to have

5. Learned A.P.P. for the State opposes the anticipatory bail application of the petitioner.

6. Considering the submissions and taking into consideration the fact that petitioner, above-named, in the event of his arrest or surrender within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Biraul P.S. Case No. 152 of 2025 subject to the conditions as laid down under Section 482 (2) of the BNSS.
