1. The Writ petition is filed seeking direction the respondent authorities to pay the admitted outstanding dues to the tune of Rs. 1,37,55,926/- towards the work done in the district of Patna pursuant to the agreement executed by the respondents with the petitioner. Further to direct the respondent authorities to make the payments of

2/5 arrears of admitted outstanding dues, @ 12% interest from the date of entitlement till the date of payment.

The brief contents of the Writ petition is that the petitioner applied for empanelment as transporting-cum-handling agent for the District of Patna being the lowest bidder and he was selected by the District Transport Committee for the tender. Thereafter, an agreement was duly executed on 21.09.2016 for a period of three years, between the petitioner and the respondent/District Manager, State Food Corporation. After allotment of the work, the petitioner carried out the work to the satisfaction of the authorities. However, the respondent authorities vide Letter No. 1046 dated 03.03.2017 directed to stop the work of transporting-cumhandling agent, pursuant to the decision of the District Transport Committee.

3. It is specific contention of the Learned counsel for the petitioner that the petitioner has worked successfully upto March, 2017. After the stoppage of the work the petitioner submitted bills before the respondent authorities but no payment was made. It is also contended by the Learned counsel for the petitioner that the bill was duly forwarded by the District Manager, to the Deputy Chief Transportation, State Food Corporation vide Letter No. 1994 dated 25.08.2017 for seeking necessary permission for payment. Further, the petitioner also made a representation before the Managing Director for making the aforesaid payments. As there was no response from the respondent authorities, the petitioner was constrained to file the present Writ petition.

4. The Learned counsel for the respondents contended that no representation was made to the

4/5 Managing Director for making the aforesaid payments, and if the petitioner makes a representation before the Managing Director, Bihar State Food and Civil Supplies Corporation, who is the competent authority, shall examine all the relevant materials and pass an appropriate order.

6. Heard the Learned counsel for the petitioner as well as the Learned counsel for the respondents.

7. On perusal of the entire record, it is evident that no representation was made to the Managing Director, BSFC. Without going into the merits of the case, this Court directs the petitioner to file representation before the 3rd respondent within four weeks from the date of receipt of this order with all relevant documents and bills to enable the Managing Director, BSFC to adjudicate the claim of the petitioner. In turn the 3rd respondent shall pass

5/5 an appropriate order within three months from the date of filing of the representation.

8. With the aforesaid observation, the Writ petition stands disposed of.

9. Interlocutory Application(s), if any, shall also disposed of.
