The petitioner seeks bail in anticipation of his arrest in connection with Fesar P.S. Case No. 23 of 2021 instituted for the offences under Section 30(a) of the Bihar Excise Prohibition Act, 2018.

Taking into consideration the liquor recovered from open place and not from the possession of the petitioner whereas allegation at best is general against the petitioner and also that co-accused has already been granted anticipatory bail, I am inclined to grant benefit of anticipatory bail to the petitioner and in the event of arrest he shall be released on bail subject to the conditions as laid down under Section 438(2) of the Criminal Procedure Code.
