Taking into consideration that there is specific allegation of rape against the petitioner, I do not feel it proper to grant him on anticipatory bail and accordingly, his prayer for anticipatory bail in connection with Kadwa (Balia Belon) P.S. case no. 131/2014 pending in the court of the Chief Judicial Magistrate, Katihar stands rejected. However, this order shall not cause any prejudice to the concerned court at the time of consideration of regular bail application of the petitioner.
