JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 15-01-2021 Heard learned counsel for the petitioner and learned Additional Public Prosecutor appearing on behalf of the State. This application for grant of regular bail arises out of Kalyanpur P.S. Case No. 25 of 2020 registered for the offence punishable under Sections 302/34 and 201 of the Indian Penal Code.

It is the prosecution's case that the informant's daughter was married to the co-accused Bablu Ram nearly three years before the alleged date of occurrence i.e. 21.01.2020. It has been alleged that the petitioner had informed the informant on 21.01.2020 that his daughter was unwell and had been taken to Srishti Poly Clinic, Kalyanpur. When the informant reached at the said clinic, he could not get any clue from the Doctors and his daughter was not found in the said clinic. Subsequently, the informant went to the matrimonial home of his daughter, where

Patna High Court CR. MISC. No.35529 of 2020(2) dt.15-01-2021 2/2 he learnt that his daughter had been killed. There is allegation in the F.I.R. of demand of a sum of Rs. 50,000/- for starting a business.

Learned counsel appearing on behalf of the petitioner has submitted that the only allegation against the petitioner is of informing the informant about the medical treatment of the deceased in the Srishti Poly Clinic. The petitioner is neither a family member of the in-laws of the deceased nor any way related to them and he is simply a neighbour of the husband of the deceased. The petitioner is in custody since 24.05.2020.

Considering the nature of allegation against the petitioner, as disclosed in the F.I.R., this application is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Samastipur in Kalyanpur P.S. Case No. 25 of 2020.
