Petitioners seek bail in a case registered for the offences punishable under Sections 272, 273 of the Indian Penal Code and Sections 47 and 53 of the Bihar Prohibition and Excise (Amendment) Act, 2016.
Petitioners are driver and khalasi of the vehicle from which recovery of foreign liquor was made. Petitioners are in custody since 04.08.2016.
Submission is that the owner of the vehicle has already been allowed bail.
Considering the aforesaid facts, let the petitioners, above named, be released on bail on furnishing bail
Patna High Court Cr.Misc. No.9555 of 2017 (3) dt.03-05-2017 2/2 bonds of Rs.10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Muzaffarpur/successor Court in connection with Gaighat Police Station Case No. 135 of 2016, subject to the condition that the petitioners shall fully cooperate with the investigation and trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioners.
