In this case, the petitioner is seeking regular bail in connection with Khaira P.S. Case No. 379 of 2019, registered for the offence under Sections 419, 420, 467, 468, 471, 120-B / 34 of the Indian Penal Code.

The Branch Manager of State Bank of India, Gopalpur Branch, gave a written report that in the account of the accused person some amount has been credited through online banking. On the basis of said written report, the Police started investigation and found to be a cyber crime. The petitioner has also been found involved in the commission of said offence. Learned counsel for the petitioner submits that the account holder namely Prince Kumar, on whose account the amount was credited through online has been granted bail by a

Patna High Court CR. MISC. No.36375 of 2020(2) dt.05-02-2021 2/2 co-ordinate Bench of this Court vide order dated 06.07.2020 passed in Criminal Miscellaneous No.20706 of 2020. He further submits that the petitioner is in jail since 27.12.2019. Looking to the period of custody as also the fact that the account holder on whose account the amount was credited through online has been granted bail by this Court, let the petitioner, above-named, be released on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Jamui / Successor Court, in connection with Khaira P.S. Case No.

379 of 2019, subject to the condition that (i) one of the bailors shall be the father of the petitioner (ii) if the petitioner is found involved, in future, in similar type of case, the prosecution will be at liberty to make prayer for cancellation of bail and (iii) the petitioner would cooperate in the proceeding of the court below. In the event of failure to appear on two consecutive dates, the court below will be at liberty to pass appropriate order including cancellation of bail bonds of the petitioner.
