JUSTICE SUDHIR SINGH ORAL ORDER 28-02-2017 Heard learned counsel for the petitioner, learned counsel for the informant and learned counsel for the State. The petitioner seeks bail in a case instituted under Sections 302, 120(B)/34 of the Indian Penal Code. The prosecution story, in brief, is that the petitioner along with nine other named accused persons caused injuries on both hands and legs of the deceased, as a result of which, the deceased died.
It has been submitted on behalf of the petitioner that the petitioner is in custody since 11.07.2015. The charge sheet has been submitted in the present case. The petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. General and omnibus
Patna High Court Cr.Misc. No.1327 of 2017 (4) dt.28-02-2017 2/2 allegation has been alleged against the petitioner. The petitioner is father-in-law of the deceased. No specific overt act has been alleged against the petitioner. The other co-accused have been granted bail vide Annexures-2 and 2/1, to the present application. On behalf of the state and the counsel for the informant, it has been submitted that the petitioner is named in the F.I.R. Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Sri Randhir Kumar, J.M.1st Class, Danapur, Patna in connection with Bikram P.S. Case No. 78 of 2015.
