JUSTICE VINOD KUMAR SINHA ORAL ORDER 29-08-2019 This is an application for grant of anticipatory bail in connection with Forbesganj P. S. Case No. 630 of 2018, disclosing offences under Sections 147, 149, 341, 323, 325, 307, 379, 504 and 506 of IPC.

Allegation against the petitioners and other accused persons is of assaulting the informant and others and specific allegation of assault is against the petitioners no.1 & 2. Submission of learned counsel for the petitioners is that there is land dispute between the parties and case and counter case between the parties and some injuries were found to be grievous but that is at the hand, which is not a vital part of the body.

Having heard both sides, considering the above submission, this application is allowed. Let the petitioners, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount to the satisfaction of learned Chief Judicial Magistrate, Araria, in connection with Forbesganj P. S. Case No. 630 of 2018, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
