The petitioners seek bail in connection with Tekari P.S. Case No.309 of 2016 registered under Sections 341, 323, 307, 354 and 379/34 of the Indian Penal Code.
The accusation is that while the informant was going to the house of her brother-in-law Siyasaran Yadav, at that time, the petitioner no.2 Dilip Yadav, the son of the petitioner no.1 Krishna Yadav caught hold of her and started to pull her towards another direction. The informant started to raised alarm and on hearing the voice of the informant, her brothers-in-law Siyasaran Yadav and Ramsaran Yadav came and tried to set her free. At that time, the petitioner no.1 Krishna
Patna High Court Cr.Misc. No.3847 of 2017 (2) dt.15-02-2017 2/2 Yadav caused blood oozing injury on the head of the informant through rod. In that course, Deosaran Yadav and, the brother of the petitioner no.1, and Indrajeet Yadav, another son of the petitioner no.1, also came there and caused injury at the shoulder of Siyasaran Yadav, the brotherin-law of the informant, through lathi and danda and they also snatched silver locket from the neck of the informant. Learned counsel appearing on behalf of the petitioners submits that due to land dispute, the hot exchange of words took place in between the petitioners and the informant but with an ulterior motive, the informant has lodged this false case. The petitioners having no criminal antecedents are in jail custody since 18.10.2016.
Having regard to the facts and the circumstances of the case, the petitioners, above named, are directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-VI, Gaya, in connection with Tekari P.S. Case No.309 of 2016.
