The dispute between the parties with regard to the land in question is also pending in the Court of Sub-Judge I, Danapur vide Title Suit No. 80 of 2020.

The Sub-Judge I, Danapur, Patna is directed to proceed with Title Suit No. 80 of 2020 on day-to-day basis and decide it in accordance with law within a year from today. The Sub-Judge I, Danapur will proceed ex parte against the nonappearing party. It has been submitted by learned counsel for the private respondent that the petitioner is not appearing in the

Patna High Court CWJC No.15288 of 2021(3) dt.01-12-2022 2/2 restoration application and he is trying to delay the matter as the petitioner has not got any relief from this Court. Non-appearance of the petitioner will further delay the matter and therefore, it will be better for the petitioner to cooperate in disposal of the miscellaneous case so that Title Suit. No. 80 of 2020 is restored.

If Title Suit. No.80 of 2020 is restored, any application for interim injunction filed by any of the parties shall be decided by the Sub-Judge I, Danapur, Patna within fifteen days of its filing.

With the aforesaid observation and direction, this writ petition is disposed of.
