Petitioner is languishing in judicial custody since 29.11.2016 in connection with Bihta P. S. Case No. 903 of 2016 registered for the offence punishable under Sections 30 (a), 37 (a), (b), (c) of the Bihar Prohibition and Excise (Amendment) Act, 2016.

The prosecution case as lodged by the police personnel is that during raid, a number of houses of many persons were raided and from the house of the petitioner, 27 liters of illegal country made Mahua wine was recovered and accordingly, seizure list was prepared.

It has been submitted by the learned counsel for the

Patna High Court Cr.Misc. No.5689 of 2017 (2) dt.22-02-2017 2/2 petitioner that he is innocent and that nothing has been recovered from his conscious possession and he does not have any criminal antecedent relating to the similar offence as he is involved in another case under Section 498A of the Indian Penal Code. Learned A.P.P. for the State submits that the petitioner is named in the F.I.R., hence, opposes the prayer for bail.

Considering the facts and circumstances and material available on record, let the petitioner, above named, to be released on bail on furnishing bail bond of Rs. 10,000/-( Rupees ten thousand) with two sureties of the like amount each in connection with Bihta P.S.Case No. 903 of 2016 to the satisfaction of the learned Additional Chief Judicial Magistrate, Danapur.
