The Petitioner seeks bail in Khaira P.S. Case No.265 of 2016 instituted for the offence under Section(s) 272, 273,/34 Indian Penal Code and Section 30-a of the Bihar Prohibition and Excise Act,2016.
It has been submitted that the driver of the pickup van, Sanjeev Kumar, who was arrested at the spot with this petitioner, has already been granted bail by a co-ordinate Bench of this Court by order dated 21.12.2106 passed in Cr. Misc. No.53041 of 2016.
It is alleged in the written report that in course of checking the police stopped one Pickup Van and this petitioner
Patna High Court Cr.Misc. No.2214 of 2017 (2) dt.02-02-2017 2/2 along with driver, Sanjeev Kumar, was found sitting in it. 864 bottles of 180 ml. foreign liquor kept in 18 cartons and 576 bottles of 750 ml. foreign liquor kept in 48 cartons along with mobile phones were seized. The driver disclosed that they have brought the liquor at the direction of one Suraj.
Since one of the co-accused has already been granted bail by a co-ordinate Bench of this Court, let the Petitioner, above named, be released on bail on furnishing bail bond of `10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Jamui, in connection with Khaira P.S. Case No.265 of 2016, subject to the conditions that both the bailors shall be the close relative of the petitioner. (Sanjay Priya, J) JA/- U T
