JUSTICE SUDHIR SINGH ORAL ORDER 21-05-2015 The petitioner is apprehending his arrest in connection with Pupri P.S.Case No. 233/2014 instituted under Sections 147, 148, 149, 341, 323, 307, 447 and 379 of the Indian Penal Code. Heard learned counsel for the petitioner and the State. The prosecution story, in brief, is that on the alleged date and time i.e. 08.10.2014 at 12 A.M. , the petitioner and accused persons entered into the house of the informant. Baijnath Sah assaulted the informant with Kudal on his head causing cut injury with bleeding. Suresh Sah also assaulted with back portion of Kudal causing injury on right shoulder and right leg causing injury with fracture and bleeding. When the wife of the informant came to save the informant, accused Pappu Sah assaulted with lathi on her shoulder and hands. Suresh Sah also took away nose
Patna High Court Cr.Misc. No.3949 of 2015 (3) dt.21-05-2015 2/2 pin and ring from the possession of the wife of the informant. It has been submitted on behalf of the petitioner that the petitioner has no criminal antecedent. Further it has been submitted that due to land dispute, the petitioner has falsely been implicated in the present case. It is also submitted that the injury caused by the petitioner is simple in nature. On behalf of the State, it has been submitted that the petitioner is named in the FIR.
Considering the aforesaid facts, let the above named petitioner, in the event of his arrest or surrender in the court below within a period of eight weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Pupri at Sitamarhi in connection with Pupri P.S.Case No.233/2014, subject to the conditions as laid down u/s 438(2) Cr.P.C.
