JUSTICE ASHUTOSH KUMAR ORAL ORDER 21-01-2022 Heard Mr. Mahendra Thakur, learned advocate for the petitioner and learned APP for the State. The petitioner seeks bail in anticipation of his arrest in connection with Hajipur Town P. S. Case No. 388 of 2020, instituted for the offences under Sections 147, 148, 341, 323, 324, 325, 354(B), 427, 379, 504 and 506 of the Indian Penal Code.

The accusation in the F.I.R. is that the petitioner along with others came to the house of the informant and assaulted his daughter with lathi.

The learned advocate for the petitioner has submitted that nothing specific has been alleged against him.

Considering the nature of accusation in the F.I.R. and no specific allegation having been levelled against the petitioner, he is directed to be released on bail, in the event of his arrest or surrender before the court below within a period of eight weeks from the date of receipt / production of a copy of this order, on his furnishing bail bonds in the sum of Rs. 10,000 /- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Vaishali at Hajipur, in connection with Hajipur Town P. S. Case No. 388 of 2020, subject to the conditions as laid down under Section 438 (2) Cr.P.C. The application stands allowed.

While saying so, this Court has taken note of the fact that the petitioner is a student of Class XII and has no criminal antecedents.
