2. Petitioner is in custody since 20.10.2016 in connection with Sirdalla P.S. Case No. 249 of 2016 for the offences punishable under Sections 30(a) of the Bihar Prohibition & Excise Act, 2016 and Section 414 of the Indian Penal Code.

3. The accusation is of carrying illegal wine.

4. Learned counsel for the petitioner has submitted that the petitioner has been implicated in this case on mere suspicion. It is further submitted that nothing has been recovered from the conscious possession of the petitioner and the petitioner has also got no criminal antecedent.

5. Considering the facts and circumstances of the

No.2007 of 2017 (2) dt.28-01-2017 2/2 case and nature of accusation, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand rupees only) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Nawada in connection with Sirdalla P.S.
