JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 16-04-2015 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. This is an application seeking anticipatory bail in a case registered for the offences punishable under Sections 147, 148, 149, 447, 341, 392, 504 and 506 of the Indian Penal Code.
As per the allegation, the accused persons including this petitioner took away hundred bags of Maize crops kept in the Basa, making the son of the informant captive.
Learned counsel for the petitioner submits that the petitioner is the brother-in-law of the co-accused, namely, Rajesh Mandal and the crop in question was, as a matter of fact, come in the field belonging to said Rajesh Mandal. He
Patna High Court Cr.Misc. No.42415 of 2014 (2) dt.16-04-2015 2/2 has submitted that the petitioner has been made an accused only to put undue pressure upon said Rajesh Mandal as there is property dispute between the informant and him. It is stated in Paragraph No. 3 of the application that petitioner has got no criminal antecedent.
In view of the above, let the petitioner, abovenamed, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate, Ist Class, Naugachia, DistrictBhagalpur, in connection with Ismailpur P.S. Case No. 32 of 2014, subject to the condition laid down under Section 438
(2) of the Code of Criminal Procedure.
