1. Heard the learned counsel for the petitioner and learned APP for the State.

2. The petitioner seeks bail in connection with Pripainti P.S. Case No. 414 of 2022 registered for the offence under Sections 324, 302, 379/34 of the Indian Penal Code.

3. As per the prosecution case, the deceased was killed and while being taken to hospital, the deceased has named this petitioner and co-accused as her assailant. Subsequently she died.

4. Learned counsel for the petitioner submits that the petitioner is 70 years old person and is in custody since 05.12.2022. He has no antecedent of similar nature.

5. Learned counsel for the petitioner further submits that the petitioner has falsely been implicated in this

6. Learned A.P.P. has vehemently opposed the prayer for bail.

7. Considering the age of the petitioner, the allegations levelled against the petitioner seems doubtful and this application for regular bail is allowed.

8. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned J.M. 1st Class Bhagalpur/ concerned Court below in connection with Pirpainti P.S. Case No. 414 of 2022.
