The petitioner is accused in connection with Piar (Hatha) P.S. Case No. 38 of 2015 registered under Section 366/34 of the Indian Penal Code.
The accusation is of kidnapping of daughter of informant by this petitioner with the help of other co-accused named in the F.I.R.
Learned counsel for the petitioner submits that, in fact, daughter of informant moved from house according to her own sweet will without giving information to her parents, this fact has been stated by the victim in her statement under Section 164 Cr.P.C. She further stated that she was not being kept properly at Calcutta by this petitioner and on receiving information about
Patna High Court Cr.Misc. No.1904 of 2017 (2) dt.20-01-2017 lodging the present case, both come in the village. Further submission is that the victim has stated in her statement about her age as 19 years. It is further submitted that petitioner has no criminal antecedent.
Having regard to the facts and the circumstances of the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate, Muzaffarpur, in connection with Piar (Hatha) P.S.
