Petitioner seeks bail in a case registered for the offences punishable under Sections 341, 323 and 365/34 of the Indian Penal Code.

According to FIR, for quarrelling between the two parties, the petitioner is suspected to have kidnapped Kanhai Sahani. Later on, dead body of Kanhai Sahani was found from river side.

The occurrence of abduction took place on 31.01.2016. The dead body was found on 03.02.2016 and on the same day post-mortem was done and the Doctor came to the conclusion that death was caused by asphyxia due to drowning within 24 hours.

Patna High Court Cr.Misc. No.2620 of 2017 (3) dt.07-03-2017 2/2 The case diary would reveal that there is no eyewitness to the occurrence. Petitioner is in custody since 15.10.2016.

Considering the aforesaid fact, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Sikarahana at Dhaka, East Champaran/successor Court in connection with Chiraiya Police Station Case No. 23 of 2016.
